A federal appeals court upheld a nine-year prison term Monday for a hacker who tried and failed to steal customer credit-card numbers from the Lowe's chain of home improvement stores.
….
Salcedo's attorney did not return a phone call Monday. Reached by phone, Timmins said Salcedo's and Botbyl's ultimate plan was to install the hacked tcpcredit code at all the Lowe's outlets, tapping into a torrent of credit-card data. "It was serious," he said. But he still wasn't expecting the sentence to survive appeal.

"I'm just kind of surprised that they upheld it," he said. "That's an incredibly long time."

DUNDALK, Md. (AP) — A woman who gave her infant daughter methadone to keep her from fussing was sentenced to eight years in prison for causing the baby's death.
Gina M. Camponeschi, 35, pleaded guilty to involuntary homicide in May. Her daughter, Adriana, was born last July addicted to heroin and cocaine because the mother used drugs during her pregnancy, prosecutors said. The newborn spent 30 days in the hospital for detoxification.

HARTFORD, Conn. (AP) — A judge on Tuesday erased the rape conviction of a man who was exonerated by DNA evidence after spending 18 years in prison.
….
Tillman was 26, living in a homeless shelter and working at a car wash when he was charged with abducting a woman as she got into her car near a Hartford restaurant, then beating and raping her at a nearby housing project. He maintained his innocence and rejected a plea bargain that would have given him eight years in prison.

Goes to show our priorities, huh?

  1. the "system" doesn't care as much about the lives of poor folk.
but the credit card theft scares the rich folk b/c it threatens their money, so they get the system to crack down.

  2. wtf? 4th Circuit? Quite possibly the most conservative Court of Appeals in the country. Why wasn't this tried in the 6th circuit where the crimes occurred? Too bad they didn't do their crimes on the West coast. They could have appealed to the 9th circuit where they actually understand technology as it applies to the law. Then again, commit the crime, do the time.

  3. I had a client get over 6 years for a peanut sized hunk of heroin that was (allegedly) found on him in the county jail, and that was HALF what he was looking at due to doubling for a prior serious felony and two extra years for prior prison sentences.. The minimum sentence laws in this country are totally fucked up.

  4. While I agree that 9 years does seem a bit on the harsh side, complaining that it's "the longest sentence" ever is a really poor argument. They have to start somewhere.

On the other hand, it's not like they were just dabbling in minor script kiddie shit, and were not aware of what they were doing. They knew full well what they were doing (just not how to properly implement it, lol). Not to mention, Salcedo was nearing the end of his probabtion for a previous computer crime. I have difficulty feeling for anyone who pulls that level of dumbfuck moves.

    1. Likewise, but we shouldn't be starting all this off at the same level people get for murder. If we are, we should up murder.
